People rest, defense calls first witness in Skaluba case

The People have rested and the defense called its first witness Thursday afternoon, in the trial of 22 year-old Nicholas Skaluba of Alpena, who stands accused of sexually assaulting two teens at separate summer parties in 2016.

An alleged third victim, who said she and Skaluba were very close friends at one time, testified for the prosecution yesterday.

She claims to have had a very similar experience to the two victims in February, 2016. She believes she was sexually assaulted by Skaluba after he drugged her, but has no recollection of the assault and charges were never filed.

The first witness for the defense was a neuropsychopharmacologist, who is basically an expert on how drugs and alcohol affect the body and mind and influence behavior. His testimony differed from the prosecution’s expert on how long the prescription drug Xanax stays in a person’s body.

The defense is expected to wrap up its case Friday, at which time jurors will begin deliberations, following closing arguments by the attorneys.

Skaluba is charged with two counts each of criminal sexual conduct first and third degree, and two counts of delivery of a controlled substance to commit criminal sexual conduct. He faces any number of years up to life in prison if convicted.
