UPDATE: DPI shooter identified & charged

The man who allegedly fired gunshots at employees of Decorative Panels International (DPI) Sunday, has been arraigned.

Benjamin C. Atwater, 58, has been charged with assault with intent to do great bodily harm less than murder, discharging a weapon in or at a building, assault with a dangerous weapon, and felony firearm.

Alpena City police said the incident occurred around 4:30 Sunday afternoon, after some employees of DPI reported incoming gunfire while they were performing maintenance on the roof. No one was injured.

The subsequent investigation led to Atwater, who lives near the plant, in the 600 block of Ford Avenue. Atwater didn’t answer repeated telephone calls from police for approximately four hours; and then at around 9 p.m., suddenly walked out of his home and was taken into custody.

It is not known why he fired shots at the men on the roof.

Atwater is being held without bond and faces a maximum penalty of up to 12 years in prison if convicted as charged.
