MI Supreme Court hears Otsego Co. environmental case

The Michigan Supreme Court heard arguments Wednesday, in a case that could set a new legal standard for some environmental disputes.
Merit Energy Co. was granted a state permit to discharge treated water into the headwaters of the Au Sable River in Otsego County.  The company has given up on the plan, but the Supreme Court still
wanted to hear an appeal from opponents.
Arguments were heard Wednesday in Lansing.
The court’s liberal majority also invited lawyers to argue whether a 2007 decision by the court’s former conservative majority in a bottled-water case should be overturned. That decision restricts who can sue under the state’s Environmental Protection Act.
