Alpena couple accused of sexually assaulting son back in court

The Alpena man and woman who allegedly sexually assaulted their biological son over a period of time were back in court this week.

Walter Deneal Massengill, 59, and Joann Marie Massengill-King, 60, are divorced but were married when the sexual assaults were alleged to have occurred in 2007 and 2008.

Their son was around 6 years-old at the time.

The attorney representing Walter said it is unlikely a plea deal will be reached with the prosecutor’s office and asked the court to set a date for a trial that will likely last three days.

The lawyer representing Joann said his client was evaluated in 2008 and found to be mentally challenged.  He asked the court to refer her for a psychiatric examination to determine competency and criminal responsibility.  Presiding Judge Michael Mack will be reviewing Joann’s mental history and plans to make a determination on a referral after that time.

The now 16 year-old victim recounted details of the frequent sexual assaults and other abuse during a preliminary examination.  He reported the incidents to his school in 2008 and was subsequently removed from the home following an abuse and neglect investigation.

The Massengill’s lost their parental rights in 2009 however investigators with the Michigan State Police said they were unable to obtain enough evidence to proceed with the sexual assault charges until recently.

Both Walter and Joann remain in jail, each on a $500,000 bond.
